Coming over from Wisconsin? Buy in Minnesota, use it in Minnesota.

Hey, I'm Brandon. I own My Dealer in Bayport. We're just across the St. Croix from Hudson, a few minutes south of Stillwater on Highway 95. If you live in Wisconsin and want to buy legal, lab-tested cannabis from a state-licensed store, you're welcome here. This page covers who can buy, the border rule, where you can actually use it in Minnesota, what the law looks like back home, and what to know on your first visit.

Who can buy

Any adult 21 or older with a valid, unexpired photo ID can buy at My Dealer. That includes Wisconsin residents. Out-of-state IDs work. Under Minnesota law, a valid driver's license or ID card from Minnesota, another state, or a Canadian province works, as long as it has your photo and date of birth. A U.S. passport, a valid Tribal ID, or a foreign passport also works. No ID, no sale. Minn. Stat. 342.27, subd. 4

Minnesota caps what a licensed retailer can sell to one customer in a single transaction: Minn. Stat. 342.27, subd. 2(c)

  • Up to 2 ounces of adult-use cannabis flower
  • Up to 8 grams of adult-use cannabis concentrate
  • Edible cannabis products and lower-potency hemp edibles with up to 800 milligrams of THC total

Edibles in Minnesota top out at 10 mg THC per serving and 200 mg per package. Minn. Stat. 342.27, subd. 2(d) The same 2 oz / 8 g / 800 mg amounts are also what an adult can carry in public in Minnesota. Minn. Stat. 342.09, subd. 1(a)

The border rule: it stays in Minnesota

I'm going to be straight with you, because I'd rather lose a sale than have you get in trouble. What you buy here is legal in Minnesota only. Taking it across the St. Croix into Wisconsin is illegal.

  • Wisconsin: THC (outside of legal hemp) is a controlled substance. A first possession conviction can mean a fine of up to $1,000, up to 6 months in jail, or both. A second or later offense is a Class I felony. Wis. Stat. 961.14(4)(t), Wis. Stat. 961.41(3g)(e)
  • Federal: marijuana is still a controlled substance under federal law, and a Minnesota license doesn't change that. 21 U.S.C. 844
  • Every package we sell carries the state-required line: "This product may be unlawful outside the state of Minnesota."

So the plan is simple: buy here, use it here, and don't bring it home.

Using it legally in Minnesota

Minnesota is specific about where adults can consume. Minn. Stat. 342.09, subd. 1(a)(7) and 1(b)

  • OK: a private residence, including its yard
  • OK: private property that isn't generally open to the public, as long as the owner hasn't told you no. If you're staying with friends or renting a place, ask first. Plenty of rentals and hotels ban it, and smoking or vaping is also off-limits anywhere Minnesota's smoking ban applies.
  • OK: a business or event licensed for on-site consumption
  • Not OK: in any motor vehicle, parked or moving, driver or passenger
  • Not OK: driving under the influence
  • Not OK: public places like parks, sidewalks, or our parking lot
  • Not OK: smoking or vaping anywhere a minor would breathe it in

There is no place to consume at My Dealer. We're a retail store only.

Short version: Wisconsin has no adult-use cannabis and no medical cannabis program. Here's what the state's own sources say.

  • Hemp: Wisconsin law excludes hemp (as defined in Wis. Stat. 94.55) from its THC definition, so legal hemp products aren't treated as marijuana under state law. Wis. Stat. 961.14(4)(t)3. DATCP ended its hemp licensing program on January 1, 2022; growers are now licensed by USDA. DATCP still publishes labeling and method-of-sale guidance for hemp flower and CBD products. DATCP Wisconsin Hemp Resources, DATCP labeling guide (PDF)
  • CBD: possessing hemp-derived CBD doesn't require a doctor's certification in Wisconsin. Other CBD products are allowed with a physician's certification. Wis. Stat. 961.32(2m)
  • Medical: Wisconsin has no medical cannabis program. A 2025-26 medical cannabis bill, SB 534, did not pass. 2025 Senate Bill 534
  • Heads up on hemp THC: federal law changes the definition of hemp. Synthetic-cannabinoid products lose hemp status on November 12, 2026, and the new total-THC limits (including 0.4 mg total THC per container for final products) take effect December 11, 2026, under current law. That will affect a lot of hemp THC products sold on both sides of the river. Congressional Research Service, IF13136

Hemp shops in Wisconsin that call themselves dispensaries aren't state-licensed cannabis retailers. There aren't any in Wisconsin.

Coming from your town

Drive times are approximate, based on typical routing to 243 3rd St N, Bayport, and depend on traffic and route. Local ordinances can change, so check the linked code before relying on it. Any local fine is on top of, not instead of, state law, and none of it makes possession legal in Wisconsin.

Hudson, WI

Drive to Bayport: About 6 miles, roughly 10 to 15 minutes, over the I-94 bridge and up Highway 95.

Local rules: City of Hudson Chapter 118 prohibits marijuana possession or use, with a forfeiture of $50 to $500 plus costs. Larger amounts or repeat offenses go to the St. Croix County DA. Hudson Code ch. 118 St. Croix County also has a possession ordinance (ch. 58) with a $125 to $500 forfeiture. St. Croix County ch. 58 (PDF) Wisconsin law says a county ordinance like this applies in every municipality in the county. Wis. Stat. 59.54(28)

River Falls, WI

Drive to Bayport: About 17 miles, roughly 25 to 30 minutes.

Local rules: Not verified: we couldn't confirm a River Falls city marijuana ordinance or fine amount in the online code. River Falls Code of Ordinances The part of River Falls in St. Croix County is covered by the county's ch. 58 ordinance ($125 to $500). St. Croix County ch. 58 (PDF) Pierce County rules for the rest of town: not verified. State law still applies everywhere. Wis. Stat. 961.41(3g)(e)

Somerset, WI

Drive to Bayport: About 11 miles, roughly 15 to 20 minutes, across the Stillwater bridge.

Local rules: Not verified: we didn't find a marijuana-specific ordinance in the Village of Somerset code. Village of Somerset code Somerset is in St. Croix County, so the county's ch. 58 ordinance ($125 to $500) applies. St. Croix County ch. 58 (PDF) Wis. Stat. 59.54(28)

Eau Claire, WI

Drive to Bayport: About 70 miles, roughly 1 hour 20 minutes to 1 hour 30 minutes, on I-94 west.

Local rules: City of Eau Claire Code 9.37: possessing 25 grams or less is an ordinance violation with a $1 forfeiture plus costs for an adult. It doesn't apply over 25 grams or if you've been charged with marijuana possession in Wisconsin before; those cases fall under state law. Eau Claire Title 9 (PDF) It's still illegal, it's still a citation, and court costs apply.

La Crosse, WI

Drive to Bayport: About 135 miles, roughly 2 hours 45 minutes to 3 hours.

Local rules: La Crosse County Ordinance 9.16 covers 25 grams or less in every municipality in the county, with a $1 forfeiture plus costs. It doesn't apply after a prior Wisconsin possession conviction. La Crosse County ch. 9 (PDF), La Crosse County ch. 25 fee schedule (PDF) The City of La Crosse also passed a $1 ordinance in 2020 (Ord. 5147). The current city code text is not verified.
